Booking Terms and Conditions

GENERAL

All key codes provided should only be shared with resident guests. Guest will be liable for any theft or damage to the property and its contents from the time of entry to the time of departure. The villas provided are strictly for corporate, holiday and personal use and must not be sub-let under any circumstance.

Business use, parties and gatherings of 8 guests or more will not be accommodated. Noise and disturbances will not be tolerated; Medlock Villas reserve the right to ask guests to vacate the villa immediately and no refund will be issued. All guests are required to accept the above and below conditions prior to booking. A passport copy of the Primary Guest will be required upon arrival as acceptance of the terms listed above and below.

1.0 CONTRACT

A contract between you and the owners will come into existence when we receive your deposit payment and accept your booking by issuing a confirmation of booking for the holiday dates shown in the rental agreement. The contract joins you & all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms & conditions of booking.

1.1 RATES

All rates quoted are exclusive of VAT (5%) and Tourism Dirham Fee of AED 60 per villa per night. Rates quoted by email or WhatsApp are valid for 24 hours and are subject to change at any time. Rates quoted on www.medlockvillas.com are accurate at the time of booking.

1.2 BOOKING

Guests can book Medlock Villas via any one of our agents including but not limited to Booking.com, Expedia, Airbnb and Agoda. All rates quoted on these websites are subject to terms and condition on those websites as well as those listed in this document.

The Booking maker must be of at least 18 years of age.

1.3 PAYEMENT

For all stays of 28 days or less, payment for your reservation must be made in full at the time of booking. Bookings will not be confirmed unless full payment is received prior to the arrival date. For stays of 28 days or more, 50% (non-refundable) of the total booking cost will be required at the time of booking followed by the remaining 50% at least 14 days prior to arrival. All stays of 14 days or more will include a ‘long stay’ discount.

Guest will receive a confirmation email of their Booking once payment is made and must make sure all details are correct. In the event that the information is incorrect, the guest must inform us immediately.

1.4 SECURITY DEPOSIT

A refundable damage deposit of AED 2,000 will be required by credit or debit card before arrival for each booking. The security deposit will be held for the duration of the booking and returned on check out subject to an inspection of the property.

The security deposit may be retained in the event of the following:

a. more than 8 guests found to be in the villa at any time (i.e. 5 adults + 3 children = 8 guests)

b. complaints from neighbors regarding noise, loud music, nuisance, or anti-social behavior

c. if music is being played inside the villa or in the garden after 8pm

d. excessive noise from shouting inside the villa or outside the villa after 8pm

e. more than 3 cars parked outside the villa or in the nearby area at any one time

f. theft, breakage, damage, stains to the villa, its fixtures, fittings, furniture, and other items supplied by the Medlock Villas

g. a late check out after 11AM which has not been agreed with Medlock Villas

h. property being left in an untidy condition, dishes not washed, waste not disposed of correctly, furniture moved out of place

i. smoking inside the villa

In the event of breach of the above points, the guest will be given 1 verbal warning and a maximum time of 10 minutes to rectify the issue. Should the issue not be resolved within 10 minutes, Medlock Villas reserve the right to cancel the booking immediately. Guests will be required to vatcate the villa and no refunds will be given for the stay or the security deposit.

If there have been any breakages during your stay, we would be grateful if you could advise us before you leave. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage found.

We reserve the right to make a charge to cover additional cleaning costs if the guest leaves the property in an unacceptable condition.

The security deposit cannot be used to pay for an extension in check out time or to cover an additional nights stay.

1.5 WILDLIFE

Many properties are in beautiful areas and nearby lakes. Please therefore expect to meet some wildlife, including the odd spider, ant, bird, fly, bee, wasp, mosquito or other creature, which may make their way into a property.

If this is likely to be a problem, it would be best not to book. (If any of these creatures are encountered, do not panic, but contact us in a calm and reasonable way – but only if the creatures become a serious menace. Otherwise, just open a window or a door and let them out, as this is usually what they prefer.) We reserve the right to take no action if we do not consider the existence of the wild life to be a serious threat to health.

1.6 CANCELLATION

All cancellations must be immediately notified by phone and then in writing. Any payments made will not be refunded. Should any guest decide to cut short their stay; the ‘long stay’ discount will be removed, and the full rate will apply for nights stayed.

We strongly recommend all guests to take out comprehensive travel insurance. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation.

Your booking will not be cancellated by us except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday. Our liability for cancellation will be limited to payments made to us.

We cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.

1.7 RIGHT TO REFUSAL

We reserve the right to refuse a booking without giving any reason.

1.8 PETS

Pets are not allowed unless otherwise agreed in writing. A surcharge of AED 200 will be required for pets per day, and an AED 250 cleaning fee will be applicable.

1.9 CHECK-IN

Check-in time is from 3:00PM. All guests are reqiured to complete an online check-in before arrival via the My Guest Area app, which we will email to all guests 7 days before arrival. Early check-in if available can be booked via the My Guest Area App. If an option for early check-in is not showing in the app, then early check-in is not possible. Failure to arrive at the property by midnight on the day of arrival will result in the booking being marked as a 'no-show', unless a late arrival time has been provided.

2.0 CHECK-OUT

Check-Out time is 11:00AM. We will email all guests a link to complete their check-out information 1 day before the check-out date. If a late check-out option is available, an option will show where you can select the check-out time and pay the additional fee.

We request all guests to leave the property in a clean and tidy state. Any guest leaving the villa in an untidy manner will be charged an additional cleaning fee of AED 1,500 which will be deducted from the security deposit. Any unconfirmed late check-outs will be charged at AED 500 per hour (rounded up to the nearest hour after 11.00AM) and this will be deducted from the security deposit. (See point 1.8.)

2.1 COMPLAINTS

All complaints must be made in writing to Medlock Villas by email during your stay. All complaints received will be investigated fully with all parties concerned and you will receive a formal reply within 3-5 working days.

Any complaints received after check-out will not be entertained. No refunds will be made to guests making complaints after check-out.

2.2 SMOKE FREE POLICY

All our villas are non-smoking. Should anyone smoke in the villas you will be fined 1,000 AED plus any additional cleaning costs. Guest can use the private garden area to smoke. All cigarettes must be disposed of correctly.

2.3 INTERNET

Hi-Speed Internet access is provided free of charge in all our Villas.

Internet services are provided by third part companies. Medlock Villas endeavor to ensure access is available 24/7; however, there may be periods where access is limited or restricted due to server maintenance or line issues.

2.4 EQUIPMENT MALFUNCTION

Whilst we make best efforts to ensure all equipment whether electrical or non-electrical is in full working order, we shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building, grounds or pool.

2.5 SWIMMING POOL

Guests must ensure no running, pushing, acrobatics / gymnastics, shouting, ducking, petting, bombing, diving or smoking takes places in and around the swimming pool area.

All children must always be supervised during their use of the pool.

2.6 HOUSEKEEPING

House-keeping is provided to all guests and is scheduled on a weekly basis from the date of check in. Guests are required to allow all housekeeping staff a minimum 60 mins to ensure housekeeping is carried out to your satisfaction. Your weekly clean will include replacement of towels and bed linen and a light clean of the villa.

Housekeeping times may vary from 11.30am – 5.00pm. Our housekeeping team will carry out the cleaning of your villa in your absence if you are not present.

2.7 MAINTENANCE

Garden are maintained daily and gardeners will access the garden area from the rear in the early hours of the morning, where possible, so as to not disturb your use the garden. Pool cleaning will take place twice every 7 days. Although Medlock Villas ensure that garden areas and pools are clean at all times, we are unable to guarantee this due to unforeseen weather conditions. No refunds will be made to guests requesting a refund due to adverse weather conditions.

2.8 SECURITY

Medlock Villas have a strict security policy. All our Villas are located in residential areas which have 24-hour security. Any security breaches by guests will result in instant cancellation of the booking. No refunds will be made on any cancellation.

2.9 LOST PROPERTY

Medlock Villas holds guest’s lost property for a period of 14 days, after which it is disposed off.

Lost property item/s can be collected from the Villa, by the owner after producing an accepted form of ID.

If the person collecting the lost property is NOT the owner, then Medlock Villas requires a “Lost Property Collection Authorisation Form” to be completed by the owner, authorising the third party to collect the items on the owner’s behalf. Medlock Villas reserves the right to refuse handing over the property if an ID is not produced by the ‘Authorised Person’ as specified by the owner.

Medlock Villas keeps the guests lost property on “All Care but No Responsibility’ principle. We therefore do not cover any costs associated with any damages or missing property after departure.

3.0 COVID (19)

All guests must ensure they are do not have any Coronavirus related symptoms, feel unwell or have been unwell in at least 14 days prior to your stay. We reserve the right to ask guests, within reason to provide a medical report for a recent Covid19 test, for the safety of our staff, potential guests, contractors and our wider community. Failure to provide a test report will result in automatic cancellation of the booking and no refunds will be given.

3.0 GOVERNMENT GUIDELINES

Guest must ensure they have permission and have sought the relevant permit(s) relating travel individually or as a group and have the required permission to do so as per government guidelines.

General Terms and Conditions

Medlock Holiday Homes Rental LLC maintains the www.medlockvillas.com Website ("Site"). The following are the terms of use that govern use of the Site ("Terms of Use"). By using the Site you expressly agree to be bound by these Terms of Use and the www.medlockvillas.com privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Site. Medlock Holiday Homes Rental LLC reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, Medlock Holiday Homes Rental LLC may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.

LIMITED LICENSE

You are granted a limited, non-exclusive, revocable and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Use. Medlock Holiday Homes Rental LLC may change, suspend, or discontinue any aspect of the Site at any time. Medlock Holiday Homes Rental LLC may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the Site. You shall have no rights to the proprietary software and related documentation, if any, provided to you in order to access the Site. Except as provided in the Terms of Use, you shall have no right to directly or indirectly, own, use, loan, sell, rent, lease, license, sublicense, assign, copy, translate, modify, adapt, improve, or create any new or derivative works from, or display, distribute, perform, or in any way exploit the Site, or any of its contents (including software) in whole or in part.

1. SITE OPERATION:

United Arab Emirates is our Country of Domicile. Medlock Holiday Homes Rental LLC controls this Site from the U.A.E. Medlock Holiday Homes Rental LLC makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

2. APPLICABLE LAW:

The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.

3. MULTI-CURRENCY PRICED TRANSACTION:

The displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.

4. PURCHASES.

Medlock Holiday Homes Rental LLC accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Medlock Holiday Homes Rental LLC. All refunds will be made onto the original mode of payment.

5. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES:

Medlock Holiday Homes Rental LLC will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific.

6. REPRESENTATIONS BY YOU:

By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Medlock Holiday Homes Rental LLC through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

7. PERMITTED USE:

You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by Medlock Holiday Homes Rental LLC to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorized by Medlock Holiday Homes Rental LLC to do so. The content and software on this Site is the property of Medlock Holiday Homes Rental LLC. The cardholder must retain a copy of transaction records and Merchant policies and rules.

8. YOUR ACCOUNT:

If you use Medlock Holiday Homes Rental LLC Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

NO COMMERCIAL USE:

This Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain Medlock Holiday Homes Rental LLC’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. Medlock Holiday Homes Rental LLC will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

LINKS AND SEARCH RESULTS:

The Site may automatically produce search results that reference and/or link to third party sites throughout the World Wide Web. Medlock Holiday Homes Rental LLC has no control over these sites or the content within them. Medlock Holiday Homes Rental LLC does not guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Medlock Holiday Homes Rental LLC does not endorse the content of any third party site, nor does it make any representation or warranty about these sites, including that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Medlock Holiday Homes Rental LLC for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. INTELLECTUAL PROPERTY:

Although Medlock Holiday Homes Rental LLC is not responsible for the content, quality or accuracy of data provided by users, compilations of such data, text, information and other materials made available to users through Medlock Holiday Homes Rental LLC’s system. The On-line Materials are Medlock Holiday Homes Rental LLC’s intellectual property, and are protected by U.S. and international intellectual property laws. The On-line Materials may not be copied or redistributed either in whole or in part without prior written consent of Medlock Holiday Homes Rental LLC, except as expressly and specifically permitted under these Terms of Use.

The On-line Materials are and will remain the exclusive property of Medlock Holiday Homes Rental LLC. All rights, titles and interests in and to the On-line Materials will be and remain vested solely in Medlock Holiday Homes Rental LLC. Under no circumstances will you have any right, directly or indirectly, to own, use, copy, loan, sell, rent, lease, license, sublicense, redistribute, assign or otherwise convey the On- line Materials, or any rights thereto, except as expressly and specifically provided in the Terms of Use. Nothing in these Terms of Use will convey to you any right, title or interest, except that of a license with the express rights and subject to all limitations herein. Nothing in these Terms of Use grants you the right, directly or indirectly, to use the On-line Materials to create a product for resale or to use the On-line Materials in any way that competes with Medlock Holiday Homes Rental LLC.

You acknowledge and agree that Medlock Holiday Homes Rental LLC will own all rights, titles and interests in and to any copy, translation, modification, adaptation, derivative work or improvement of the On- line Materials made by or for you. At Medlock Holiday Homes Rental LLC’s request, you must execute, or obtain the execution of, any instrument that may be necessary to assign these rights, titles or interests to Medlock Holiday Homes Rental LLC or perfect these rights, titles or interests in Medlock Holiday Homes Rental LLC’s name.

DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES. VIOLATION OF TERMS OF USE:

You understand and agree that in Medlock Holiday Homes Rental LLC’s sole discretion, and without prior notice, Medlock Holiday Homes Rental LLC may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information, if Medlock Holiday Homes Rental LLC believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of Medlock Holiday Homes Rental LLC, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to Medlock Holiday Homes Rental LLC for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Medlock Holiday Homes Rental LLC may release user information about you if required by law or subpoena.

INDEMNITY:

You agree to indemnify and hold Medlock Holiday Homes Rental LLC, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.

LICENCE GRANTED TO YOU:

By providing materials to Medlock Holiday Homes Rental LLC, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted Medlock Holiday Homes Rental LLC an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. Medlock Holiday Homes Rental LLC may publish and distribute any such submitted content or materials at its sole discretion by any method now existing or later developed. You agree that you shall waive all claims and have no recourse against Medlock Holiday Homes Rental LLC for any alleged or actual infringement or misappropriation of any proprietary rights in any communication, content or material submitted to Medlock Holiday Homes Rental LLC. Any communication or materials you send to Medlock Holiday Homes Rental LLC will be treated as non- confidential and non-proprietary and may be disseminated or used by Medlock Holiday Homes Rental LLC for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.

ADVERTISING:

The Site may contain advertisements and/or sponsorships. The advertisers and/or sponsors that provide these advertisements and sponsorships are solely responsible for insuring that the materials submitted for inclusion on the Site are accurate and comply with all applicable laws Medlock Holiday Homes Rental LLC is not responsible for the acts or omissions of any advertiser or sponsor.

SEVERABILITY:

If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.
